University Hearing and Appeals System

If the survivor was assaulted by another Northwestern student, they have the option of filing a complaint through the University's disciplinary system, the University Hearing and Appeals System (UHAS). UHAS is separate and distinct from any legal or criminal process and is specifically designed to address student related concerns. All staff affiliated with UHAS are specifically trained in responding to reports of sexual misconduct, stalking, and dating and domestic violence.

If you submit a report and decide to utilize UHAS you will begin by meeting with an investigator. The investigator is responsible for exploring all aspects of your case, speaking with you, the respondent, and any witnesses, and reviewing all available documentation and evidence. The investigator will write a report of findings that will be sent to you, the respondent, and a hearing panel.

The hearing panel is three faculty or staff members who have specific training for these cases. Once everyone has reviewed the investigator’s report, you will meet with the panel who will hear any thoughts you have about the report or any additional information you want to share. The respondent will also meet with the panel, separate from you. You are welcome to have an advisor with you at all times throughout the process.

The Panel will use a preponderance of evidence standard (more likely than not) to first decide if the respondent is responsible for violations of University policy. If the respondent is found responsible for a violation of University policy, the Panel will issue sanctions up to and including expulsion. After a hearing, each party has the right to appeal the outcome.

Even if you do not want to participate in the full UHAS process we encourage you to file a report. This will enable the Deputy Title IX Coordinator to offer you support and resources to remediate the impact of this experience on your education and to help prevent its recurrence. Some lower level concerns may also be able to be resolved through an administrative hearing.
