Advanced Legal Communication: Advocacy, Argument, and Drafting

- The goal of this course is to allow students to experience tasks and assignments typically given to a junior associate. Thus the students will work through a case file just like a lawyer does in practice. There will be both oral and written assignments of different levels of formality, ranging from a quick email to a document presented to a court. The substantive assignments will grow out of the case file and include analytical work, either predictive or persuasive or both, client letters and formal or informal presentations, or both. Some assignments will involve either transactional or litigation-oriented drafting, or both. Examples of these assignments include a complaint, a contract or a client's employment policy, or even depending on the case file, proposed legislation. There will be an in-class peer review of most written assignments. Students will be required to work in groups on some assignments and individually on others. A few assignments will allow students to work either individually or in groups at their option. Students should be prepared to offer contributions to the course design, as the professor tailors it, to some degree, based on preferences of the class for one type of assignment or another.
