Is Health Insurance Mandate Constitutional?


Law professors offer opposing views on the legality of the health care act

CHICAGO --- With the Supreme Court’s decision to take up several issues surrounding the Patient Protection and Affordable Care Act, the highest court in the land will become a proving ground for one of President Obama’s signature pieces of legislation.

At the core of the arguments before the court will be the constitutionality of a mandate requiring all Americans to purchase or carry health insurance in 2014.

In this audio commentary, Eugene Kontorovich and Andrew Koppelman, both professors of law at Northwestern University, discuss their differing views on the legal issues surrounding the health care act and how those issues may play out before the Supreme Court.
